Terms of Service

These Terms of Service ("Terms") govern your use of the mobile game DeepDriller ("the App"), developed by Adam Matossian ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
This agreement is between you and Adam Matossian only, not with Apple. Apple is not responsible for the App or its content.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial entertainment on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions (including the "Licensed Application End User License Agreement," or "Standard EULA"). These Terms supplement, and do not replace, Apple's Standard EULA; where they conflict, Apple's Standard EULA controls for matters it governs.
2. Acceptable use
You agree not to:
- Reverse engineer, decompile, or disassemble the App, except to the extent permitted by law;
- Modify, tamper with, or create derivative works of the App;
- Use cheats, exploits, automation, or modifications that gain an unfair advantage, manipulate leaderboards, or disrupt other players;
- Distribute, sell, rent, sublicense, or commercially exploit the App; or
- Use the App in any unlawful manner or in violation of these Terms.
We may suspend or remove leaderboard entries that we reasonably believe were obtained through cheating or manipulation.
3. In-app purchases
The App offers optional in-app purchases of virtual items and currency. All purchases are:
- Processed by Apple through the App Store;
- For a license to use virtual items within the App only — virtual items have no monetary value, cannot be exchanged for real money, and are non-transferable;
- Generally final and non-refundable, except as required by law or under Apple's refund policy. We do not process refunds directly; refund requests must be made to Apple.
We may change the price, availability, or contents of in-app purchases at any time. Virtual items may be modified or removed as part of game balancing or updates.
4. Game content and updates
The App is a roguelite game; gameplay outcomes, procedurally generated content, and progression are part of the intended experience. We may update, change, or discontinue features, content, or the App itself at any time without liability to you.
5. Intellectual property
The App and all associated content — including code, art, audio, characters, world, and the names "DeepDriller" and "UNDERLODE" — are owned by Adam Matossian and protected by intellectual-property laws. Except for the license granted above, no rights are transferred to you.
6. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADAM MATOSSIAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR PROGRESS, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP AND ITS IN-APP PURCHASES IN THE 12 MONTHS PRECEDING THE CLAIM.
8. Apple-specific terms
You acknowledge that:
- These Terms are between you and us only, not Apple;
- Apple has no obligation to provide maintenance or support for the App;
- In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App;
- Apple is not responsible for addressing any claims relating to the App, including product-liability, regulatory, or intellectual-property claims;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Termination
This license is effective until terminated. Your rights terminate automatically if you breach these Terms. Upon termination, you must stop using the App and delete all copies.
10. Governing law
These Terms are governed by the laws of your jurisdiction of residence to the extent required by applicable consumer-protection law; otherwise, by the laws applicable to the developer's place of residence, without regard to conflict-of-law principles.
11. Changes to these Terms
We may revise these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance.
